Determination in the fight against corruption is one of the main focuses of the European Union's policy, according to Commission President Ursula von der Leyen in her 2022 State of the Union address. The proposal for a directive on combating corruption published on May 3, 2023, is intended to contribute significantly to this objective. Member States are to be obliged to punish all forms of corruption beyond the classic bribery offenses with stricter criminal sanctions for natural and legal persons. Well-trained personnel are to investigate effectively in specialized anti-corruption units and cooperate with competent authorities from other Member States across borders.
This is just a part of the measures presented. However, the intended introduction of a harmonized legal framework raises the question of what is really needed to detect corruption, investigate it with evidentiary certainty and punish it in a deterrent manner.
Against this background, we will discuss with experts the proposed legislation and its possible impact on the judiciary and business. Interested experts are invited to participate online.
